Welcome to Learn Heal Thrive. These Terms of Service ("Terms") govern your use of the learnhealthrive.ca website, our courses, and our content. By using our site, you agree to these Terms.

1. Who We Are

Learn Heal Thrive is operated by Melisha Franks, a Registered Psychologist based in Medicine Hat, Alberta, Canada.

2. Important: Educational Content, Not Clinical Care

Please read this section carefully.

The content, courses, workbooks, articles, videos, and other materials provided through Learn Heal Thrive are educational in nature. They are NOT:

  • Psychological therapy or clinical mental health treatment

  • A substitute for consultation with a qualified mental health professional

  • Diagnostic tools for mental health conditions

  • Treatment for any mental health condition

  • A therapist-client or doctor-patient relationship

Although Learn Heal Thrive is founded by Melisha Franks, a Registered Psychologist, your engagement with this platform does not constitute a clinical psychological service. No therapist-client relationship is formed through your use of this site, courses, or materials.

If you are experiencing mental health concerns, including thoughts of self-harm, please contact a qualified mental health professional in your area, your physician, or emergency services.

Crisis resources:

3. Eligibility

You must be at least 18 years old to use our services or purchase our courses. By using the site, you confirm you are 18 or older.

4. Account and Access

When you purchase a course, you receive personal access for your individual use. You agree:

  • Not to share your login credentials with others

  • Not to allow others to use your access

  • To keep your password secure

  • To notify us immediately of any unauthorized access

We reserve the right to suspend or revoke access for violations of these Terms.

5. Course Access and Use

When you purchase a course (such as Relationship Super Powers), you receive:

  • Lifetime access to the course materials at the version available at time of purchase

  • The right to view, learn from, and apply the content for personal use

You may not:

  • Reproduce, copy, or distribute course materials

  • Resell or share course content

  • Use course materials for commercial purposes

  • Reverse-engineer or extract content for use elsewhere

  • Share access with anyone outside your household

Violations may result in immediate access termination without refund.

6. Payments

  • All prices are listed in Canadian dollars (CAD) unless otherwise stated

  • Payment is processed securely by our payment providers (Wix Payments, Stripe, or PayPal)

  • We do not store your full payment card information

  • All sales are final. See Section 7 below

7. All Sales Final, No Refunds

Please read this section carefully before purchasing.

All purchases of digital products from Learn Heal Thrive, including but not limited to Relationship Super Powers, Healing Betrayal Trauma Wounds, and any other courses, workbooks, or digital materials, are FINAL. We do not offer refunds.

This applies regardless of:

  • Whether you've started or completed the course

  • Whether the content meets your expectations

  • Changes to your personal circumstances

  • Technical issues you encounter on your end (we'll work to resolve any technical issues but will not refund based on them)

  • Time elapsed since purchase

By completing your purchase, you acknowledge and agree that no refunds will be issued.

Why this policy: Our digital products are delivered immediately upon purchase, and once accessed, the content cannot be returned. Our pricing reflects this no-refund structure. We encourage you to review course descriptions, sample content, and our free resources thoroughly before purchasing.

Free resources available before purchase:

  • The free Relationship Skills Workbook

  • Course descriptions and curriculum overviews

  • Free articles on the Skills Lab blog

8. Free Resources

Free resources (such as the Relationship Skills Workbook) are provided for personal, non-commercial use. You may not redistribute, resell, or modify these materials.

9. User Conduct

When using our site or services, you agree not to:

  • Submit false or misleading information

  • Use the site for unlawful purposes

  • Attempt to gain unauthorized access to our systems

  • Harass, threaten, or harm others (including replies to our emails)

  • Submit spam or malicious content

  • Violate the intellectual property rights of others

10. Intellectual Property

All content on Learn Heal Thrive (text, graphics, logos, images, videos, course materials, workbooks) is the property of Learn Heal Thrive or its licensors, protected by copyright and trademark laws.

You receive a limited, personal, non-transferable licence to use our content for educational purposes. All other rights are reserved.

11. User-Generated Content

If you submit content to us (replies, testimonials, comments, etc.), you grant us a non-exclusive, royalty-free licence to use that content for marketing, education, or operational purposes, including anonymously if you prefer.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Our services are provided "as is" without warranties of any kind

  • We do not guarantee specific outcomes or results from our courses or content

  • We are not liable for indirect, incidental, or consequential damages

  • Our total liability is limited to the amount you paid for the specific product giving rise to the claim

  • Following our content does not guarantee any specific relationship, mental health, or personal outcome

You acknowledge that personal change is complex and depends on many factors beyond our content.

13. Indemnification

You agree to indemnify and hold harmless Learn Heal Thrive, its founder, and affiliates from any claims arising from your violation of these Terms or misuse of our services.

14. Privacy

Your use of the site is also governed by our Privacy Policy.

15. Modifications

We may update these Terms from time to time. Continued use of the site after changes constitutes acceptance. Significant changes will be communicated via email or site notice.

16. Termination

We may terminate or suspend your access at any time for violations of these Terms. You may stop using our services at any time.

17. Chargebacks

If you initiate a credit card chargeback rather than contacting us first, we reserve the right to:

  • Suspend your access to all purchased products

  • Dispute the chargeback with documentation, including your acknowledgment of these Terms

  • Refuse future purchases

  • Pursue collection for chargeback fees and lost revenue

We strongly encourage you to email contact@learnhealthrive.ca with any concerns. We will work with you to address technical issues or course access problems.

18. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Alberta, Canada.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
